User agreement summary: These Terms explain the rules for using the JCI Mobile App, including accounts, payments, community conduct, and governing law.
1. Acceptance of Terms
These Terms and Conditions (“Terms”) are a legal agreement between the user (“you” or “user”) and Oyu Intelligence LLC (“Operator,” “we,” “us,” or “our”) regarding access to and use of the JCI Mobile App (the “App”), available at jci.oyu.ml.
By downloading, accessing, creating an account, registering for an event, submitting content, or using the App, you agree to these Terms. If you do not agree, you should not use the App.
2. About the JCI Mobile App
The App is a mobile application for JCI members, community users, event participants, administrators, and guests. It may provide access to JCI-related information, announcements, event details, registrations, resources, communications, membership activities, and other app-based services.
The specific features available to each user may depend on account type, membership status, chapter or organization role, location, event access, administrator permissions, device type, and the current version of the App.
3. Eligibility and User Accounts
To use certain features, users may be required to create an account, provide accurate information, verify identity or contact details, accept invitations, or be approved by an administrator.
Users must be at least 18 years old or otherwise legally permitted to use the App under applicable law. Where a minor is permitted to use the App, use may require consent or authorization from a parent, guardian, chapter, or other authorized organization.
- You agree to provide accurate, current, and complete information.
- You agree to update your information if it changes.
- You agree not to create accounts using false, misleading, unauthorized, or third-party information.
- We may reject, suspend, limit, or terminate accounts where information appears inaccurate, unauthorized, abusive, or inconsistent with these Terms.
4. Account Security Responsibilities
Users are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their accounts, except where caused by the Operator’s proven security failure or where applicable law provides otherwise.
You should promptly notify us at boldbat.api@gmail.com if you suspect unauthorized access, misuse of your account, or any security issue. We may require a password reset, re-authentication, account verification, or other security steps.
5. Permitted Use of the App
You may use the App only for lawful, authorized, and intended purposes connected with JCI-related information, community participation, event engagement, membership activities, communications, and services made available through the App.
You agree to use the App in a respectful manner and in accordance with these Terms, applicable law, community guidelines, event rules, administrator instructions, and any additional policies presented in the App.
6. Prohibited Conduct
You must not misuse the App or interfere with the rights, safety, privacy, or experience of others. Prohibited conduct includes:
- Using the App for unlawful, fraudulent, harmful, abusive, harassing, defamatory, hateful, discriminatory, threatening, or misleading purposes.
- Uploading malware, harmful code, spam, unauthorized advertising, or content that violates another person’s rights.
- Attempting to access accounts, systems, data, admin functions, or areas of the App without permission.
- Scraping, copying, reverse engineering, decompiling, or interfering with the App except where legally permitted.
- Impersonating another person, organization, administrator, chapter, or official representative without authorization.
- Collecting or sharing other users’ personal information without lawful authority and consent where required.
- Circumventing security controls, payment systems, access restrictions, usage limits, or event registration rules.
- Using the App in any manner that could damage, disable, overload, or impair the App or related services.
7. Membership, Events, Registrations, and App-Based Services
The App may provide access to membership-related information, chapter resources, events, registrations, attendance features, announcements, surveys, feedback, and other services. Availability of these features may vary and may be managed by administrators, chapters, event organizers, or authorized partners.
Event information, schedules, locations, speaker details, participation requirements, and capacity may change. Users are responsible for reviewing event details, eligibility requirements, codes of conduct, deadlines, and any separate terms provided by event organizers.
Registration through the App does not guarantee admission, participation, certification, benefits, or membership status unless confirmed by the relevant organizer or authorized administrator.
8. Payments, Subscriptions, Fees, Donations, Ticketing, and Refunds, Where Applicable
Where the App supports payments, users may be able to pay for event tickets, membership dues, subscriptions, donations, or other paid services. Payments are processed by QPay, or by Apple, Google, or another authorized payment provider where their billing applies.
All prices, fees, currencies, taxes, payment methods, billing cycles, cancellation rights, renewal rules, and refund policies are displayed before purchase or described in the relevant payment flow. Unless otherwise stated, payments are subject to the payment provider’s terms and processing rules.
- Payment confirmation may be required before access is granted.
- We may cancel or reverse access if payment fails, is disputed, is refunded, or appears fraudulent.
- Some fees may be non-refundable where legally permitted and clearly disclosed.
- Users should keep receipts, transaction IDs, and payment confirmations for support requests.
9. User Content and Uploaded Materials
Users may submit profile details, messages, comments, images, files, feedback, survey responses, inquiries, or other materials (“User Content”). You remain responsible for your User Content.
By submitting User Content, you confirm that you have the rights and permissions needed to submit it and that it does not violate law, privacy rights, intellectual property rights, confidentiality obligations, community rules, or these Terms.
You grant the Operator a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, transmit, moderate, and use your User Content as reasonably necessary to operate, secure, improve, and provide the App and related services. This license does not transfer ownership of your User Content to us.
We may remove, restrict, or preserve User Content where we reasonably believe it violates these Terms, creates risk, is unlawful, infringes rights, affects safety, or is required for legal or operational reasons.
10. Intellectual Property Rights
The App, including its software, design, interface, graphics, layout, logos, text, features, databases, and other materials, is owned by or licensed to the Operator and is protected by applicable intellectual property laws.
Except for rights expressly granted in these Terms, users receive no ownership rights in the App. Users may not copy, distribute, modify, sell, lease, sublicense, publicly display, create derivative works from, or exploit the App without prior written permission, except where permitted by law.
Any JCI-related names, marks, logos, chapter names, event names, or partner materials used in the App are used only with proper authorization and in accordance with applicable brand and licensing rules.
11. App Updates, Availability, and Maintenance
We may update, improve, suspend, restrict, replace, or discontinue any part of the App at any time. Updates may be required for security, compatibility, performance, legal compliance, or new features.
The App may be unavailable from time to time due to maintenance, technical issues, third-party provider outages, network conditions, app store policies, device compatibility issues, or circumstances beyond our control. We do not guarantee uninterrupted, error-free, or permanently available operation.
12. Third-Party Links, Services, and Integrations
The App may link to or integrate third-party websites, services, maps, payment processors, analytics tools, communication providers, authentication systems, app stores, or other external platforms. These services are not controlled by us and may have their own terms, privacy policies, security practices, and fees.
We are not responsible for third-party services except to the extent required by applicable law or agreed in writing. Users should review the terms and privacy policies of third-party services before using them.
13. Push Notifications and Communications
By using the App, users may receive service-related communications, such as account notices, security alerts, event reminders, registration updates, announcements, and administrative messages. Some communications may be essential to the operation of the App.
Users may manage push notifications through device settings and available app preferences. Turning off notifications may affect the user’s ability to receive timely updates about events, services, or account activity.
14. Relationship to the Privacy Notice
Our collection and use of personal information is described in the Privacy Notice made available through the App and at jci.oyu.ml/privacy. The Privacy Notice should be read together with these Terms.
If there is a conflict between these Terms and the Privacy Notice regarding personal information, the Privacy Notice will generally control for privacy-specific matters, unless applicable law requires a different result.
15. Disclaimers
The App is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law. We do not promise that the App will be uninterrupted, error-free, secure, complete, accurate, or suitable for every user’s needs.
Information in the App, including event details, announcements, resources, user content, membership information, and third-party content, may be updated, incomplete, or subject to change. Users should confirm important information with the relevant organizer, administrator, chapter, or official source before relying on it.
Nothing in these Terms limits any rights that cannot be limited under applicable law.
16. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator and its officers, directors, employees, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, opportunity, or business arising from or related to the App.
To the maximum extent permitted by applicable law, our total liability for any claim relating to the App will be limited to the amount paid by the user to the Operator for the specific App service giving rise to the claim during the three months before the claim arose.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, limitations apply only to the maximum extent permitted by law.
17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Operator and its officers, directors, employees, contractors, partners, and service providers from claims, losses, damages, liabilities, costs, and expenses arising from or related to your misuse of the App, violation of these Terms, violation of law, infringement of third-party rights, or User Content.
18. Suspension and Termination
We may suspend, restrict, or terminate access to the App if we reasonably believe that a user has violated these Terms, created security or legal risk, misused the App, provided inaccurate information, failed to pay applicable fees, or acted in a way that may harm users, administrators, event organizers, the Operator, or third parties.
Users may stop using the App at any time and may request account deletion where available. Termination does not automatically remove obligations that should reasonably survive, including payment obligations, intellectual property rights, disclaimers, liability limitations, dispute terms, and provisions related to prior misuse.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in the App, legal requirements, operational practices, or available services. The updated version will be identified by a new “Last updated” date.
Where required by law or where changes are material, we may provide additional notice through the App, by email, or by other reasonable means. Continued use of the App after updated Terms become effective means you accept the updated Terms from that date.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of Mongolia, without regard to conflict of law principles, unless mandatory consumer or data protection laws provide otherwise.
Any dispute arising from or relating to the App or these Terms will be resolved through good-faith negotiation first, and, if unresolved, through the competent courts of Mongolia, except where applicable law requires another forum or method.
